
A man who knew he was HIV positive before getting married and hid this fact from his wife was sentenced to 10 months in prison for “intentionally causing injury to a woman”.
The court made a decision about the fact that the spouse knew he was HIV positive before marriage.
A lawsuit was filed against EK, who was determined to be HIV-positive before his marriage and whose treatment was initiated at two hospitals on December 8, 2022 and January 3, 2023, on the grounds that he hid this from his wife and asked for a prison sentence of 13 to 20 years for “intentionally killing his spouse”.
The Istanbul Supreme Criminal Court announced that the complainant's HIV virus test was negative in the test.
Indicating that the nature of defendant EK's crime had changed, the court sentenced the defendant to 10 months in prison for “Intentionally causing injury to a woman”. The Committee decided to postpone the announcement of the verdict.
The file was sent to the Istanbul Regional Court of Justice upon objection.
The appeal is filed after completing the review of the file and finding that the decision of the local court is legal.
He hides it from his wife
EK, who received treatment and started taking medication after testing positive in two hospitals, married KK on February 26, 2023.
EK, who submitted the health report obtained as part of the wedding ceremony to the city authorities after his wife said he was busy with work, hid his illness from his wife and told his wife, who saw him taking medication, that he was taking them due to an infection.
When KK was cleaning the house, he found his wife's medicine box and a paper saying “Hepatitis B vaccination is appropriate” in his pocket. Although EK claimed that his friend put the medicine in his pocket, he and his wife tested again and the results were HIV positive.
HIS WIFE COMPLAINTS
An indictment was prepared against EK after KK filed a complaint through her lawyer against her husband, who had hidden his illness from her.
The indictment states that, according to documents sent to the investigation file by the Provincial General Department of Health and a report by the Institute of Forensic Medicine, it was determined that the defendant was infected with HIV before the date of marriage, in tests he performed at two different hospitals on December 8, 2022 and January 3, 2023, and began treatment.

The indictment clearly states that the defendant had sex with his wife, disregarded the plaintiff's health, even though he knew he was infected with the virus before getting married, but it is recommended that the defendant be sentenced to 13 to 20 years in prison for the crime of “Intentionally killing his wife.”
