
The defendant, who tried to commit suicide after killing his brother with a gun and escaping in Erzurum's Aziziye district, was sentenced to aggravated life imprisonment.
The verdict was announced in the case of the defendant who killed his brother on January 21 in Erzurum.
The wife of the deceased Doğuhan Yavuz (28 years old), BCY, witnesses and lawyers of the parties attended the hearing at the Erzurum 1st Supreme Criminal Court. Detained defendant Batuhan Yavuz (30 years old) attended the hearing through the Audio and Video Information System (SEGBİS) from his prison.
Witness SK, in his testimony, said they were with the victim at around 10:30 a.m. on the day of the incident and according to the victim, defendant Yavuz called for assistance in delivering the house.
“HE LOVES YOU SO MUCH”
Claiming that he did not hear the victim and defendant Yavuz argue even once, SK said: “The victim loved his brother very much. I never heard him curse or insult his brother.” he said.
BCY participated in claiming that defendant Yavuz lied and asserted that they did not see any mess when entering the house.
“He cursed and insulted me”
During his defense, defendant Yavuz testified that he felt remorseful and said: “I loved him more than my life, but… he cursed me, insulted me, pushed me. The argument became increasingly heated. When he started moving towards me, I used the gun to shoot him.” he declared.
In his opinion on the crime, the prosecutor said that the defendant Yavuz admitted his actions, determined the act of intentional murder and requested that he be punished for the crimes of “Attempted murder” and “Violation of the law on guns, knives and other tools”, not reduce the sentence and continue to be detained.
When asked for his last words, Yavuz said: “I have nothing to say.” he said.
The sentence is heavier than life imprisonment
The jury that heard the case sentenced defendant Batuhan Yavuz to aggravated life imprisonment for “intentional murder”.
The jury also sentenced the defendant to 2 years in prison and a judicial fine for “violating the law on guns, knives and other tools” without imposing a penalty or mitigating unfair provocation.
Background of the incident
In the indictment, an aggravated life imprisonment is requested for the actions of detainee Batuhan Yavuz against his brother for “qualified intentional homicide”, and a fine and imprisonment of 2 to 4 years for “violation of the law regarding guns, knives and other tools”.
Batuhan Yavuz, who shot dead his brother Doğuhan Yavuz (28) on January 21 at his house in Saltuklu district, Aziziye Central district, escaped in his vehicle after the incident, tried to commit suicide by locking the door when police stopped him near the bus stop, and was seriously injured. After 20 days of treatment, he was arrested after surviving a life-threatening condition.
