
The 11th Judicial Package also includes an important provision for mentally ill criminals. According to the proposal, people who commit more serious crimes or are imprisoned for life will have to stay in a mental hospital for at least 1 year.
Security measures applied to criminals deemed mentally unstable are changing. Depending on the sentence, hospitalization for at least 6 months or 1 year is required.
THE PURPOSE IS TO PREVENT INTERVENTION IN SOCIAL LIFE WITHOUT RESTORATION.
The provisions in the Eleventh Judicial Package aim to prevent the premature and uncontrolled return to social life of those who have not completed treatment.
According to Article 57 of the Turkish Penal Code, mentally ill people are not punished with imprisonment but must be ordered to take security precautions.
With the change, those in this range will not only be under short-term observation, but will also have to undergo a multifaceted treatment and recovery process.
A return to social life will be possible when specific security and recovery conditions are met.
The period of rehabilitation and treatment is determined to be at least 1 month for aggravated life imprisonment and life imprisonment, 6 months for penalties of 10 years or more.
