
Tuanay Çetin, who killed Birol Şakir Kaya, whom he claimed to have abused, in Kocaeli, was sentenced to aggravated life imprisonment. The defendant said: “The person I killed was artificial intelligence, not Uncle Şakir.” he declared.
The murder occurred on June 27, 2023, at the market in Değirmendere Kaptanlar district of Gölcük district.
Drug addict Tuanay Çetin approached market trader Birol Şakir Kaya, who opened his stall, and asked for money. When Çetin received negative feedback, he repeatedly hit Birol Şakir Kaya on the head with an iron bar, killing him.
CRIME FILES INCREASE
Tuay Çetin, who had a record of 60 crimes and was known to have been released from prison four days ago for another crime, escaped.
Tuyet Çetin was arrested by the police after the procedure.
A lawsuit was filed against Tuanay Çetin, asking for an aggravated life sentence for “murder with monstrous emotions or by torture”.
He claims he was abused
During the first hearing at the Kocaeli Supreme Criminal Court No. 1 in December 2023, the detained defendant claimed that Birol Şakir Kaya sexually abused him when he was 13 years old.
Defendant Çetin said: “I never told this incident to my family. I was afraid to tell my family. I couldn't tell anyone because they would exclude me.” he said.
DECISION HEARING
While detained defendant Çetin attended the decision hearing through the Audio and Video Information System (SEGBİS); The children of Kaya, who was murdered, and lawyers for all parties were present at the trial.
Birol Şakir Kaya's children, who were present at the trial, demanded that the defendant receive the harshest punishment.
“YOUR DAD IS NOT DEAD”
Defendant Tuanay Çetin, who was asked for his last words before sentencing, said: “Birol Şakir Kaya is someone I love very much. The person I killed was artificial intelligence, not Uncle Şakir. Uncle Şakir is definitely not dead, he opened the market for 7 months.” he declared.
Turning to Kaya's children, the defendant said: “Your father is not dead.”
The defendant's lawyer argued that the defendant did not have criminal capacity and requested an acquittal.
The court sentenced the defendant to an aggravated life sentence for “murder with monstrous emotions or torture”.
