It was declared that Bölükbaşı was guilty of “insulting the memory of Atatürk, inciting society to hatred and hostility, inciting the public to commit crimes, inciting the public to kill each other” and he was tried.
A lawsuit was filed against Bölükbaşı at Istanbul's Criminal Court of First Instance No. 44, demanding a prison sentence of up to three years for “publicly insulting and cursing” Atatürk. Bölükbaşı affirmed at the hearing that he did not make this post.
The court noted that Bölükbaşı committed the crime through the press and repeated the crime several times, and sentenced him to 1 year, 10 months and 15 days in prison. The court imposed a 'good behavior discount' on Bölükbaşı, reducing his sentence to 1 year, 6 months and 22 days, and postponed the announcement of the sentence. If Bölükbaşı commits the same crime within 5 years, he must also serve this prison sentence.
